1. General
The following General Terms and Conditions apply to all agreements, deliveries and any other services. We explicitly oppose any provisions from our contracting partners that deviate from our terms and conditions. All supplementary agreements must be confirmed by us in writing.
2. Timeframe for Concluding the Agreement
You place a firm order for items in the shopping cart by clicking on the "Confirm Order" button. The order is confirmed immediately after being submitted. The purchasing agreement is established at the same time as our shipping confirmation or delivery of the goods.
3. Access to the Agreement
The agreement has been saved. You can access the general agreement conditions at any time on this webpage.
4. Right to Cancel
As a user as defined in Paragraph 13 of the German Civil Code, you are no longer bound to your order if you cancel the order within 2 weeks after receiving the goods. The cancellation does not have to be justified and can be done in writing (e-mail is sufficient) or by returning the goods. During this period, you can satisfy the requirements by returning the goods in a timely manner to the senders adress of your delivered package.
Upon exercising your right to cancel the order, you are obligated to return the complete shipment to us at our cost and risk. Shipping costs are to be paid by the customer if the value of the order is less than EUR 40.- . It is then assumed that the delivered goods are not the same as the goods that were ordered.
Please apply enough postage to the package in order to avoid any postage surcharges. We shall reimburse your for postage if the return shipment costs are to be paid by us. If you can only return a portion of the goods, none of the goods or goods that have deteriorated, you will have to accept a refund based on current value; you can avoid this by simply subjecting the goods to a test, which might have been possible in the retail shop and then returning them in the original packaging without any trace of wear and tear.
Excluded from return shipments are:
- Items that have been produced in accordance with customer specifications or have been customised to meet unique requirements, items that are not suited for return shipment due to their condition or quick deterioration, or items for which the expiration date has passed.
- Audio, video tapes or software (CDs/DVDs)
- Newspapers, magazines and illustrated publications.
- Files (Audio- or Videorecordings), which were downloaded directly from our server.
5. Warranty
The warranty is provided in accordance with the law. In the case of defective goods, you can choose whether we should immediately deliver new items or repair the items received. If repairs are unsuccessful or the newly shipped items are also defective, you can return the items in question for a full refund or you can keep them for a reduced purchase price. Please refer to the product documentation for any warranty by the manufacturer.
6. Delivery and Payment
The Kurious Rekords shop's delivery and payment terms are explained in more detail on the order form. There are no minimum order quantities. Special shipments requested by our customers are calculated based on additional customary local charges.
Please see the product description for the estimated delivery time. If no details are provided there, delivery will occur as quickly as possible (usually within 2 working days), but within 7 days at the latest. An agreement for longer delivery times is possible upon request.
We reserve the right to provide partial deliveries in quantities deemed reasonable by you. Additional shipping costs only apply if explicitly agreed.
Delivery of the goods occurs ex stock to the purchasing address unless otherwise agreed.
7. Delivery Times
Items that are in stock will be shipped as soon as possible, but within 14 days at the latest. You will be notified by e-mail if any items are not available.
8. Retention of Title
All items remain the property of Kurious Rekords, until complete payment has been received.
9. Data Privacy Declaration
We use your data solely for the purpose of processing your order. All customer information is stored and processed by us in accordance with the German Data Protection Act and the Teleservice Data Protection Act.
You are entitled to receive information, to rectify, suspend and delete your stored data at any time, free of charge. Please send an e-mail to info@kuriouskurt.com or send us your requirements by post or fax.
We do not distribute any of your personal information, including your physical address and e-mail address, to any third party without your explicit, revocable consent. An exception to this are our service partners who need your data to carry out the terms of your order (e.g. the shipping company who is in charge of delivering your order and the credit company who is responsible for processing your payment). In these cases, the information that is submitted to them is kept to an absolute minimum.
Cookies used in this shop are only to recognise your current shopping/purchase and do not affect anything else. No personal data will be stored or filed.
Your personal password and login enables you to track your latest purchase and the previous purchases.
10. Jurisdiction
The place of delivery and the place of jurisdiction for both parties is the registered office of Kurious Rekords. Only the laws of the Swiss Confederation are applicable with the exception of UN purchasing regulations. Court of jurisdiction is Zug, county Zug, Switzerland.
11. Copyright
Any and all representations and texts contained in the Kurious Rekords Homepage are protected by copyright, including the afore-mentioned General Terms and Conditions. Any use, duplication, or reproduction, etc. of the Online Ordering programme is strictly prohibited without explicit prior approval by Kurious Rekords.
